Rip-Off

Read the small print described as a promo, $5.95 becomes $95.00. I threw the watch away before I realized. Wondered how anybody could sell a watch for $6.00. The "junk" watch was cheap tin "stainless steel" and dye pressed front radiated cheap. Shocked when my credit card came. Fell for pop-up thought was partner of Barnes&Nobel site I was on.

Comments and Analysis

Often you can unknowingly join a plan simply by accepting an introductory offer of merchandise or services. Continuity plans may offer an introductory "free trial period" to let you check out the merchandise or service and decide whether to join. If you keep the merchandise or service beyond the free trial period or fail to cancel the service within the free trial period not only must you pay you automatically become a plan member. Joining a continuity plan means you agree to the plan's sales method as long as you're a member. You'll automatically get periodic shipments of merchandise or delivery of services without any announcements or rejection forms before each shipment or service period. The shipments or services continue until you cancel your membership.~~Review your monthly statement carefully. If you discover a charge which is unfamiliar investigate and dispute the amount with your card issuer as soon as possible to protect yourself from making unwanted purchases. Most credit card issuers will allow the cardholder 60 days to dispute an unauthorized or inaccurate charge.~~The Federal Trade Commission enforces the Pre-notification Negative Option Rule. Under federal law advertisers are required to disclose a description of the product or service; the specific billing information that will be used; all fees and costs that the consumer will be charged including shipping and handling; the name of the entity charging the consumer if it is not identified in the offer (particularly relevant in up sells). A description of how the charge will appear on the consumer's billing statement if the billing descriptor will not contain the name of the billing entity or product; the amount of any subsequent charges and their dates or frequency; any other material limitations or conditions to receiving or using the product or service; and the consumer's steps for cancellation. The Rule requires all companies to give their customers information about their plans clearly and conspicuously in any promotional materials that consumers can use to enroll. If the sales presentation for a plan is made orally say on the phone the terms and conditions still must be disclosed clearly and conspicuously during the presentation.

Other Considerations

This company runs third party pop up ads on other websites offering a gift in exchange for taking their survey. The requirement to receive the gift is to pay only a $5.99 shipping and handling charge. Typically customers complain that shortly after they incur an unexpected $95 charge. In some cases consumers find they are unable to contact the company to arrange returns ask for credit or cancel the membership

~

The company's terms and conditions state you will be billed $5.99 for a 14 day trial shipment. Upon the expiration of the trial period your credit card will be billed the retail price of $95 for the full cost of the item and you will be enrolled in a 30-day autoship program. Every 30 days after that you will be shipped another item from their collection and billed the retail price of $49.99 until you cancel the membership.

Before you join a buying club or agree to a promotion consider the following tips:
~· Research the company online first by checking with BCA for complaints and reviews. Keep in mind that just because you don't find complaints it doesn't mean the plan doesn't have problems.
· Read all terms conditions and policies before you agree so you are aware of your obligations before you join. If you aren't sure exactly what you're agreeing to don't sign up.
~· Really think about the offer and consider if it is the bargain or deal the offer claims to be. Count the costs including how much you will have to pay for future shipments the quality of the product or service as well as shipping and handling fees.
~· Watch out for offers that already have pre-checked boxes and free trials; they may not be free after all. Sometimes dishonest companies use free trials to enroll you in a buying club. When you sign up online you may see a box already checked that gives the company the okay to continue the offer beyond the free trial  or to sign you up to buy more products unless you un-check it.
~If you do agree to join keep copies of documents. Keep track of when you placed your order and mark your calendar with important dates so you are mindful or cancellation periods offer time frames etc. Monitor your statements to identify unauthorized or incorrect charges. If you experience problems file a complaint with BCA.
